2140 In suing for invasion of privacy based on unlawful tapping of plaintiff's phone, plaintiff may assert common law actions in addition to a statutory action under PenC 637.2 and may demand punitive damages in the common law claims and statutory penalties in the Penal Code claim, but must elect between them after the verdict.
