3255 Unless it was obtained by fraud, a favorable judgment on the merits in an underlying action is conclusive proof that the action was supported by probable cause, even if it is reversed on appeal, and continuing the action after the reversal does not subject the party who did so to subsequent liability for malicious prosecution.
