P0145 When a trial court orders a case to arbitration, it loses jurisdiction to dismiss it for failure diligently to prosecute; in determining whether an arbitration agreement is void for unconscionability, an appellate court should apply appropriate rules set forth in earlier judicial decisions (i.e., Armendariz, infra) even if they were published after entry of the order under consideration.
