3520 A restaurant floor manager whose duties, in addition to serving patrons, included supervising, disciplining, hiring, and recommending the discharge of servers was an agent of the employer, so a restaurant policy requiring servers to share their tips with floor managers violated the Labor Code and was an unfair business practice.
