3704 Whether a person suing for wrongful termination in violation of public policy was an employee or an independent contractor depends on many factors, the most important of which is whether the hiring party exercised control over the way the hired party performed the work; in the face of a dispute supported by conflicting evidence from both sides, the question should not have been resolved as a matter of law.
