3716 REVIEW DENIED When a public entity operates a flood control system built by someone else, it accepts liability as if it had planned and built the system itself, and although it may owe no duty to upgrade the system, it may be liable for failing to take steps to prevent seepage and thus ensure achieving flood control capacity as planned.
