3778 REVIEW DENIED The state of California is not the employer of a City of Berkeley firefighter and so can not be liable to him for employment discrimination under the FEHA; the state can not be liable as an aider and abettor under the FEHA, because it does not fit the FEHA definition of a "person" who may be liable.
