3932 Under an amendment to the Labor Code, CAL-OSHA violations can be used to establish negligence per se in an action other than by an employee against his/her employer and can also be used to establish duty leading to common law negligence liability in such an action, but the amendment can not be applied to actions that arose before its effective date.
