4291 REVIEW DENIED In deciding a SLAPP motion brought by a defendant being sued for malicious prosecution of an underlying malicious prosecution action previously brought by the defendant in the second action against plaintiff in the second action, the court must determine whether the plaintiff in the second malicious prosecution action had probable cause to believe that the defendant in the second action lacked probable cause for the first malicious prosecution action that he had brought against the person who is now the plaintiff in the second action.
