P0935 If there is a legitimate factual dispute about whether conduct from which a cause of action arose is validly protected by the constitution, the issue of constitutional validity should not be addressed in deciding whether the SLAPP statute applies to the action, but rather in deciding whether plaintiff can make out a prima facie case.
