P0959           REVIEW GRANTED  A contractual obligation to indemnify is determined by the language of the contract, so one who agreed to indemnify another for defense costs in any suit arising from the indemnitor's work is liable for the indemnitee's defense costs in such a suit, regardless of fault; following a decision by the California Supreme Court holding that a supplier of component parts used in the construction of mass-produced homes could be strictly liable for defects in the components, a trial court was correct in granting a new trial to a plaintiff whose strict liability claim previously had been dismissed on the basis of a prior Court of Appeal decision holding that strict liability could not be applied.
