4453 An expert's declaration stating that it was below the appropriate standard of care for defendant physician to fail to timely obtain and study the results of an MRI he ordered for plaintiff and for defendant to assume without confirmation that serious spinal injuries had been ruled out by staff members of a hospital to which he sent plaintiff for evaluation was sufficient to raise questions of fact that should have defeated summary judgment for defendant.
